Unconstitutional Search Leads to Case Dismissal

Client was indicted for conspiracy with the intent to distribute multiple kilos of cocaine from Mexico to Connecticut and faced a mandatory minimum of 10 years.

C.W. followed Attorney Brown's advice and did not give any statements to the DEA agents.

C.W.'s vehicle was searched and evidence was recovered from them. Attorney Brown filed a Successful Motion to Suppress the search and any information from the phones. The search was unconstitutional as the vehicle was a work vehicle not alleged to be involved in the conspiracy, there was no warrant for the vehicle, and the DEA agent had to open a container to locate the phones.

After this was suppressed, the Government moved to dismiss the case without prejudice and CW still has a clean record.
