Appeals Court Grants New Trial in Brown v. Commissioner
Pat Brown represented Mr. Roger Brown who appealed a denial of his third habeas petition. The Appellate Court reversed the judgement of the habeas Court on August 26th and remanded with instructions to grant the Petition for Habeas Corpus finding that his prior habeas lawyers were ineffective for not presenting evidence that his original trial counsel did not file a motion to dismiss on Statue of Limitations grounds. The remand mandated that the Petitioner be granted a new trial. This is a rare win for successive habeas claims.
